Terms and Conditions of Use of Festool GmbH, Wertstrasse 20, 73240 Wendlingen am Neckar, Germany (hereinafter referred to as “Festool”) with regard to the gratuitous provision of information and/or information materials on this website.

I. General:

Festool operates this website for itself and for the following affiliated companies in line with section 15 of the German Stock Corporation Act (AktG): TTS Tooltechnic Systems SE & Co. KG, Festool Deutschland GmbH, TTS Cleantec GmbH, Tanos GmbH, TTS Microcell GmbH (hereinafter referred to as "affiliated companies").
The provision of information and/or information materials such as videos, text, press and image materials (hereinafter referred to as "content") occurs exclusively subject to the conditions below.
By using this site, you consent to the following Terms and Conditions of Use. However, these Terms and Conditions of Use shall be deemed to have been accepted upon receipt or download of the content at the latest. They shall also apply to future use.
 

II. Rights of use:

All content shall remain the property of Festool, its affiliated companies and/or the originator at all times and shall be protected by copyright.
The user shall have the right to download and/or reproduce the content insofar as this is solely for the user’s own information.
This does not confer the right to change all or part of the content or to process it in any other way.
Use of the content for one’s own commercial purposes or commercial use by third parties is also prohibited unless otherwise agreed in writing. This shall apply in particular to publishing on the Internet and to making the content available to download elsewhere.
However, links to this Festool website are permitted. 
Where a link is integrated, the user must include the copyright notice “Festool (www.festool-group.com)” on their website.
In the event that the user infringes any of the above provisions, the user shall be liable for compensation and shall release Festool from all claims asserted by third parties.
If the user becomes aware of any commercial use, any unauthorised copying, modifications or other processing, or of any unauthorised publication, the user shall notify Festool immediately.


III. Brands and logos:

The brands and logos used on this website are the property of Festool or its affiliated companies. The use of brands and logos without the prior written consent of their owner is prohibited.


IV. Hyperlinks:

The Festool website may contain hyperlinks to third-party websites. Festool shall not accept responsibility for the content of these websites, nor shall Festool adopt as its own these websites or their content. Festool has checked the external content of any external links in order to determine any legal infringements the first time the link was set up. At that time, no legal infringements were apparent. However, if any legal infringements become known, any external links of this kind shall be removed immediately. 


V. Warranty, liability:

Liability for ensuring that the content is free from material defects and defects of title, in particular with regard to the absence of errors, accuracy, freedom from third-party intellectual property rights and copyrights, completeness and fitness for purpose, is excluded. This shall not apply if the defect is caused by malicious intent, gross negligence or fraudulent intent.
Claims to compensation asserted by the user are excluded, regardless of the legal basis, particularly those associated with a breach of contract. This shall not apply in the event of malicious intent, gross negligence or the absence of guaranteed features or if claims are made in accordance with the German Product Liability Act.
Liability for losses arising in connection with visiting third-party websites shall also be excluded.
Liability for consequential damage shall be excluded by agreement between the parties.
Before the material is downloaded, the user shall provide appropriate security devices and virus scanners for the user’s own protection and to prevent viruses on the Festool website. We shall not accept any liability for software and hardware errors that arise during the online transfer of the material or when using our system. 


VI. Final provisions:

The sole place of jurisdiction shall be the registered office of Festool, provided that the customer placing the order is a merchant within the meaning of the German Commercial Code.
German law shall apply.
Festool reserves the right to change the material currently being provided without undue delay. Furthermore, Festool shall have the right to change the terms and conditions named above provided that reasonable notice is given.
